How do you avoid the FDA?
We don't. And neither should you. We cannot give legal advice, but it is our opinion that so long as what you are doing does not infringe on the domains of conventional medicine, and you are not misleading people in your presentations, you should have nothing to fear of the FDA. Depending on what you are doing with the machine, and what you say about it, the risks you take will eventually catch up with you, even if you are very reserved in the way you share it with others.
We are not running an illegal operation here, and we have nothing to hide. So we do not live in fear as do so many others. Competitors should be conscious of this, because there is nothing stopping us from suing those who have plagiarized us. We have only been lenient about our information for the reason that there is a real need for the public to become aware of the technology, and because we very much believe in individual rights, the right to know, and the right to free speech. Mr. Wright is from Berkeley California, where if your neighbor has a 15 foot pot plant in his back yard, it is customary to ignore it.
The time of free give-away's is over. Imitation may be a form of flattery, but the reasons for our continued tolerance have essentially ceased to exist, so our tolerance for infringement is at an end. If you have used our materials on your web site, it would be a good idea to take them down. If you believe you have been given permission to use anything that belongs to us, or employ "fair use" according to copyright rules, make sure that we are given proper credit and display it prominently.
Fair warning. If we find that our materials have been plagiarized on your web site or other printed materials, we will issue a warning of infringement, either by e-mail or other means. If you ignore it you will soon be defending yourself. The penalties for copyright infringement on our materials are the same as if you had copied and distributed music, movies or any other intellectual property.
This goes the same for any materials that we have removed from the Internet, as well. Just because we are no longer publishing it does not mean that it belongs to you. It does NOT require that a copyright notice be given. You know who you are and we know who you are.
